House Rules

Governing to the use of contents of BeonIT GmbH&Co.KG (beonit)
Supplementing the general Terms of Use, our House Rules regulate the relations among members and the regulatory action of beonit in the event that a breach of the House Rules is developing or has already been detected and reported. We ask our members' cooperation to ensure that all member profiles conform to the House Rules. Incoming complaints will be reviewed in detail. Please understand that we cannot personally reply to every message we receive.
These House Rules may be updated from time to time. The valid version of the House Rules may be downloaded from the website, and it is obligatory upon publication. Members will not be individually notified of updates.

1. Sole Discretion of beonit
It is beonit's sole discretion, if and how beonit will react to any breach of the House Rules. In addition, the assessment that a breach of the House Rules has occurred is at beonit's discretion. Users of the portal may not demand that particular actions are taken.
The expulsion of users based on breaches of the House Rules as assessed by beonit may be executed without grounds, at the sole discretion of beonit.

2. Picture Content
Pictures published by users must not violate the law. Pictures with pornographic or erotic content, glorifying violence, or deemed otherwise inappropriate for the portal by beonit, must be deleted.
We also point out that picture contents may be protected by copyright and that their publication may be an infringement of international copyright laws (UrhG). If a user publishes a picture without permission to do so, he may be liable to civil and criminal prosecution.

3. Text Content
Articles, nicknames, and user profiles must not contain, pornographic, discriminating, or glorifyingly violent passages.
Texts are subject to copyright laws. Unless the author has granted the right of use to a third party, this person may not distribute the text. If this happens anyway, the perpetrator may be subject to civil or criminal prosecution. Private messages must not be distributed. If one person sends another a letter, an e-mail, a messenger note, or similar, the recipient may not publicly quote this text, unless the author has given his express permission.

4. Video / Music Content
Video and Music file attachments are subject to copyright. If the author or publisher of a document does not own the copyright of a video or music attachement, applicable fees must be paid to GEMA in Germany. beonit will not be held liable in this event. The author of a document is solely responsible for his/her actions.
(In the event of copyright infringements, server log files will be used to determine the IP address and e-mail address of the person who published the document in question.)

5. Contents of Links, Value Added Services
Links published in profiles or articles must not point to websites containing pornographic, discriminating, or gloryfyingly violent contents. Links to other profiles may be published only with the expressed permission of the owner of the profile in question. We reserve the right to deactivate profiles which are in breach of this provision.
Commercial 900-numbers (0190) and similar phone numbers involving charges to the caller are not desired inside beonit portals. In the event that a member of beonit cannot be reached by another telephone number, the telephone charges per minute must be clearly shown next to the published number. beonit reserves the right to delete customer profiles which are in breach of this provision.

6. Contents of Profiles
Profiles serve as a member's self-portrait. We reserve the right to deactivate profiles which are misused for political purposes or which are apparently false. beonit is expressly permitted to delete „faked“ profiles, if the user does not submit proof of the validity of certain details questioned by beonit.

7. Conduct during Chat
If a user breaches the House Rules, i.e. by insulting other users, the members offended by him may inform beonit about the incident. We reserve the right to exclude the offending user from the chat.
Spam-Scrolling is strictly prohibited. Spam-Scrolling is an action initiated by a chat user which causes the screens of other members to scroll continuously. Spam-Scrolling is typically caused by a user typing random characters, pressing the return button repeatedly, or initiating other actions which lead to scrolling. The same applies to disruption of dialog. This happens when a user intentionally disrupts an ongoing conversation inside a chatroom, by repeatedly interrupting other members, insulting them, using propaganda and inciting hostilities.

8. Chain Letters and Pyramid Schemes
The transmission of chain letters and messages distributed by pyramid schemes is not permitted. Doing so is considered annoying be many users. Certain chain letters and pyramid schemes are also illegal. Letters and messages offering products and services, which are based on the distribution of chain letters may be against the law.

9. Breach of the House Rules by e-mail or messenger
We are unable to take action against a user who commits a breach of the House Rules by using e-mail, because this user acts from outside the beonit server environment. We ask recipients to report the abuse and to act on their own behalf to get the perpetrator to stop.
The same applies to abuse via messenger. Any user may block other users in messenger.

10. Conflict among Users
If there is a conflict among two or more users, the user should solve the conflict directly, without involving beonit. Such conflicts should not be made public, i.e. as the topic of an article or discussion forum.

11. Advertisement by beonit
beonit is permitted to place banner ads and other forms of advertisement inside the community at any time. This is provision is valid even if a user feels inconvenienced by it.

12. Automated Access
Automated access to our servers, i.e. using scripts, is not permitted.
